小黑狗溺斃　男非故意虐狗不起訴

【潘岳／宜蘭報導】宜蘭蘇澳一家海鮮餐廳，半年多前，有員工發現廚房一只裝滿摻有洗碗精的水桶，淹死一隻流浪小黑狗，經調閱錄影帶，發現是常到店裡的劉姓遊覽司機所為，乃向宜蘭縣動植物防疫所提出檢舉，致劉男被依違反《動物保護法》移送法辦。

宜蘭地檢署調閱錄影帶，發現劉男確實有以洗碗精幫小黑狗洗澡動作，採信劉男說詞，當時是好心幫這隻惡臭小黑狗洗澡，因臨時接到電話匆匆離開，忘了水桶中有小黑狗，才會導致小黑狗溺斃，並認為劉男主觀上並無故意虐狗之情，今天對劉男做出不起訴處分。

宜蘭縣動植物防疫所股長劉必揚表示，將研議是否另依《動物保護法》25條：故意使動物遭受虐待或傷害，致動物肢體嚴重殘缺、重要器官功能喪失或死亡，處新臺幣二十萬元以上一百萬元以下罰鍰，對劉男祭出行政裁罰。
