台北地院交保裁定　高院認為理由仍不詳

農曆年前駕砂石車衝撞總統府的男子張德正（41歲），被台北地檢署聲請羈押後，台北地院第3次裁定15萬元交保並限制住居等，但高院再次撤銷發回，主要理由認為，台北地院雖認為張男涉嫌殺人未遂罪重大，也有逃亡、再犯之虞，對社會治安影響重大，但卻僅以被告身體狀況不佳，即認為無羈押必要，並未詳敘理由。
 
並且，該裁定也已混淆羈押必要性及執行羈押可能性，又裁定15萬元交保，也未說明是如何斟酌被告資力、家庭狀況，該金額就能確保張男不會逃亡。
 
另要求張男不得從事與醫療及訴訟以外無關的活動，對本案或其他涉訟等當事人、家人，不得實施危害、恐嚇行為，也未說明理由，因此高院仍認為有欠周延，再度撤銷，發回台北地院。（孫友廉／新北報導）
