老翁貪小便宜　偷70元三明治判拘58天

84歲的林姓老翁，今年4月中旬，跑到彰化市一家便利商店，偷拿2塊三明治放在外套內，要離去時被店員發現報警，老翁被逮後辯稱沒謀生能力，偷三明治是為充飢、當早餐。但法官發現林男素行不佳，且老翁身上搜出的發票顯示，當日老翁還有拿出1千元買其他物品，共找零776元，認為老翁是不願意、而非不能給付三明治費用，今依竊盜罪判處林翁拘役58天，可以每日1千元代價易科罰金，共需繳交5萬8千元。

法官審理時發現，林翁每個月領有7千元的老農津貼，卻因貪小便宜，恣意竊取他人財物，多次被逮，其他法官多次考量林翁年邁，給予減刑機會，多次從輕處罰，但老翁卻不因有9次竊盜前科而引以為戒，上月中旬，老翁又再度犯案。（詹智淵╱彰化報導）
